I sat caddy-corner from a Hispanic co-worker with a table
fan blowing on me...and blocking the air from her..She also
sat opposite from a black female with a 15 inch partition who also had a table fan blowing directly at the Hispanic
co-worker. I am a white male- For weeks and weeks the H/F
constantly complained..infact came to my desk and disrupted
my work styation alledging the fan was disturbing her..yet
never complained about the black female who's fan was blowing air on her face...She even came to my desk and shouted at me..It once resulted in a minor altercation..
and the manager was informed of this..he called me into
the offcice to advise me(but wasn't in the office that day)
that a written warning was being placed into my folder
for alledgedly disrupting the unit..as was told to him
by another supervisor..I filed charged with EEOC,, and
although an investigator came in..none of my -co-workers
wanted to speak up..My attorney and I filed a complaint in
court..And I was ready to state my caes..in that she was
causing a hostile working environment...However, when he
spoke to the judge..he said the judge sounded indignant
(angry over something that was silly. I knew I had a racial
harrassment case..I knew the fan wasn;'t bothering her
since I sat far away enough from her and that I was
blocking the fan from her..The company agreed to pay
out of pocket expenses..and I never went to court....
