Aetna Employer Discrimination



I was diagnosed with hepatitis C which was contracted during
the birth of my last child. I had to go through Interferon
treatment for a year. The position I was in was very stressful so I asked if I could go to a less stressful position, one that I had been at prior to my illness. I was told that the only way I could go to that position was to "quit" and be rehired. I gave my notice knowing that they were interviewing for the position. (When I left the position, I left at the highest level) I e-mailed the HR Manager and advise why I was doing what I was doing (quitting to be rehired)I had a 3 week notice, which would have allowed me ample time of rescinding my resignation if for some reason I did not get the position I was applying for. Two days later, they packed up my desk while I was at a meeting and called me into a conference room....I was fired. Needless to say I was not rehired.. I filed a complaint with the Civil Rights Commission and they ruled in my favor. Then, AETNA filed for summary judgement saying that hepatitis C is not a disease that is acknowledged by the ADA. Since there was no prescedence (sp?) the case was dismissed. I have filed an appeal and will go to the panel in March. If I am successful, I will SET the prescedence for all people who suffer from hepatitis C (close to 4 million in the US)and AETNA will NOT get off on a technicality. There other defense is that I was not a good employee although 1 month before they canned me from my 8 year job, my yearly raise was increased! They had no problem with me until they found out I had HCV. I'd love to know if there are other Aetna employees who have filed discrimination suits!
