Boss exposing himself to me is not sexual harrassment!

I can't believe that the law does not consider the fact that my boss exposed himself to me fully nude as sexual harrassment. My boss fully exposed himself to me on September 18th. I was his only employee. I had no one to complain to. I felt that I had to quit my job. Now I have been told that the "hostile environment" basically only includes rape. The fact that he apologized to me right away and asked me to come back to work frees him from any responsibility he had. I can't believe a reasonable person would go back to work in that environment. I work late on some nights and frankly I would be afraid to go back to work for him. Now I am angry and depressed and have been told by attorneys that there is nothing I can do short of filing criminal charges. I have filed the criminal charges but I haven't heard anything back from the police since mid October. Furthermore my former boss is a lawyer practicing in California where the investigative unit of the State Bar has been disbanded.
