Timothy Tymkovich

Nominated to the United States Court of Appeals, 10th Circuit, Tymkovich was confirmed on April 1, 2003.

  • As Colorado Solicitor General, Tymkovich argued before the Supreme Court in Romer v. Evans that Colorado's constitutional amendment prohibiting municipalities and government agencies from banning discrimination against lesbian and gays should be upheld. The amendment, adopted by state-wide voter referendum, voided anti-discrimination laws previously adopted in Aspen, Boulder, and Denver. In defending this ballot measure Tymkovich stated that lesbians and gays as groups "tend to be better educated, wealthier, and possess greater political clout than the public generally, and surely when compared with other protected minorities."*
  • Testified to the Senate Governmental Affairs Committee against the federal requirement that states receiving medicaid funds must pay for abortion services for low-income women in the cases of rape and incest.

  • He is a member of the Federalist Society, an ultra-conservative legal organization.
